ARTICLE 3 - APPLICABILITY
These general terms and conditions apply to every offer from the entrepreneur and to every distance contract and order between the entrepreneur and the consumer.
Before the distance contract is concluded, the text of these general terms and conditions will be made available to the consumer. If this is not reasonably possible, it will be indicated before the distance contract is concluded that the general terms and conditions can be inspected at the entrepreneur’s premises and will be sent free of charge to the consumer upon request as soon as possible.
If the distance contract is concluded electronically, the text of these general terms and conditions may be provided electronically to the consumer in such a way that it can be stored on a durable medium. If this is not reasonably possible, it will be indicated where the general terms and conditions can be inspected electronically and that they will be sent electronically or otherwise free of charge upon request by the consumer.
If specific product or service terms apply in addition to these general terms and conditions, then the second and third paragraphs apply accordingly, and the consumer can always invoke the most favorable applicable provision in the event of conflicting terms.
ARTICLE 4 - THE OFFER
If an offer has a limited validity period or is subject to conditions, this will be explicitly stated in the offer.
The offer is non-binding. The entrepreneur is entitled to change and adapt the offer.
The offer contains a complete and accurate description of the offered products and/or services. The description is sufficiently detailed to enable a proper assessment of the offer by the consumer. If the entrepreneur uses images, these are a true representation of the offered products and/or services. Obvious mistakes or errors in the offer do not bind the entrepreneur.
All images, specifications, and details in the offer are indicative and cannot lead to compensation or termination of the contract.
Images of products are a true representation of the offered products. The entrepreneur cannot guarantee that the displayed colors exactly match the real colors of the products.
Each offer contains such information that it is clear to the consumer what rights and obligations are attached to the acceptance of the offer.
ARTICLE 5 - THE AGREEMENT
The agreement is established, subject to the provisions of paragraph 4, at the moment the consumer accepts the offer and meets the stated conditions.
If the consumer has accepted the offer electronically, the entrepreneur will immediately confirm receipt of the acceptance electronically.
The entrepreneur may investigate whether the consumer can meet their payment obligations and responsibly enter into the contract. If the entrepreneur has legitimate grounds based on this investigation, they are entitled to refuse an order or request with motivation.
ARTICLE 6 - RIGHT OF WITHDRAWAL
The consumer has the right to withdraw from the agreement within 14 days without giving reasons.
ARTICLE 7 - COSTS IN CASE OF WITHDRAWAL
If the consumer exercises their right of withdrawal, the return shipping costs will be borne by the consumer.
ARTICLE 8 - EXCLUSIONS FROM THE RIGHT OF WITHDRAWAL
The entrepreneur may exclude the consumer’s right of withdrawal for certain products as described in paragraphs 2 and 3.
The exclusion of the right of withdrawal only applies if the entrepreneur has clearly stated this in the offer, at least in time for the conclusion of the agreement.
Exclusion is possible for the following products:
-
Products that are custom-made for the consumer.
-
Products that spoil quickly or have a limited shelf life.
-
Sealed products that are not suitable for return due to health or hygiene reasons and have been unsealed after delivery.
-
Products that, by their nature, are irrevocably mixed with other products after delivery.
-
Digital content that is not delivered on a tangible medium if the execution has begun with the consumer’s prior express consent and acknowledgment that they lose their right of withdrawal.
ARTICLE 9 - PRICES
The prices of our products and services are subject to change without notice.
We reserve the right to modify or discontinue the Service (or any part or content thereof) without notice at any time.
We shall not be liable to you or to any third party for any modification, price change, suspension, or discontinuance of the Service.
ARTICLE 10 - CONFORMITY AND WARRANTY
The entrepreneur guarantees that the products and/or services comply with the agreement, the specifications listed in the offer, and the reasonable requirements of reliability and usability.
A warranty provided by the entrepreneur, manufacturer, or importer does not limit the legal rights and claims that the consumer can assert under the agreement.
ARTICLE 11 - PERSONAL INFORMATION
Your submission of personal information through the store is governed by our Privacy Policy.
ARTICLE 12 - ERRORS, INACCURACIES, AND OMISSIONS
We reserve the right to correct any errors, inaccuracies, or omissions and to change or update information or cancel orders if any information in the Service or on any related website is inaccurate at any time without prior notice.
ARTICLE 13 - CHANGES TO TERMS OF SERVICE
We reserve the right, at our sole discretion, to update, modify, or replace any part of these Terms of Service by posting updates and changes to our website.
